unpaid medical bills


What is the name of your state? rhode island

Hi, I just got a certified letter in the mail today saying that i am being sued for past medical bills for my son. I am to have medical insurance for him per the divorce decree. (which i have always had) In my divorce decree, it does not state as to who is to pay the deductable or any monies that are not covered by the insurance company. All it says is that i should hold insurance for him. The x wife always brings him to the doctors and she is the one who signs the (encounter form) which i believe says " that she is liable if the bills are not paid. She never tells me when he is going nor for what reason. So why am i getting sued. My son just graduated high school this past June so he will be on his own soon for insurance. Don't get me wrong i will pay if i have too, but isn't there something legally i can do to make her pay them or even half. At this stage of the game, I am not willing to go back to court that would be pointless and she and i are not on speaking terms where i can ask her to pay half due to a paternity test that proved i am not his father. It is not a good situation, but is there anything i can do? If i call the lawyer who mailed this to me and asked him to bill her half and i would pay the other half do you think that might work??? Thanks

The hospital is suing me. The hospital went to a collection agency. I got the small claims court notice from the collection agency (lawyer's firm) on behalf of the hospital.

In my state a medical provider can go after both parents for unpaid medical bills, so it may be the same in your state.

You probably need to consult a local attorney.
