Usage of Minor Name in Minnesota


What is the name of your state?What is the name of your state? Minnesota

Is there a law in Minnesota regarding the usage of a minors name on the internet ?? (a 2 year old) The name is being used in an online journal blog.

Does it need to be conscented by BOTH adults?

And if usage is entirely harmless such as "so and so said the cutest thing today" or "so and so and so and so went to the fair today" and that is all could legal action really be taken against a person for using a child's name?

and if they use no name and use "someone" instead can you also get them in trouble legally?

Please help.

It's the name of a child?

I do not understand what you are talking about with copyright stamp or trademark.

Apparently I need this in black and white.

O.K. black and white.

No, it is not illegal. Your child has no ownership rights to his/her name and neither do you. I can use your name as I see fit within the law. Which means, as long as I want to call myself John Wayne I can.

What I cannot do is call myself John Wayne and commit a fraud, something which is NOT happening here.

Can someonelse use his name on an online journal? that is what I am asking. someone that is not a mother or a father but is merely a girlfriend or fiance?

And if this is not illegal are there any laws anywhere in writing that states this is ok or not ok to be doing. I have done some research but can't seem to come up with ANYTHING on the topic.

Do you know this person who's using the kids name on the blog?

It is also possible that this person may have the same name as the child. Do you know how many John Smiths there are in the world? It would be the same with any name, common names anyways.

Yes it is my ex-boyfriends current girlfriend.

She talks about what they did that day, or what new phrase he came up with. (the dad and I have 50/50 custody)

it's all very harmless but I am wondering without consent from both parents is she allowed to do use his name on the internet?

I have heard it could be considered "exploiting a child"

IT doesn't matter if you know the person, if the person has the same name or not or even if the other person is an alien.

IT IS NOT ILLEGAL.

it's not about them trying to annoy me it's about me trying to get the laws right.

if she is doing anything illegal that involves my son's name I want to know. And if it's illegal by her doing it without my consent I want to know.

I have not been able to find any paperwork online on this and can't afford a consultation here. They are all about $100 flat fee. And I just wanted a simple answer is all.

The reason you can't find anything about it is because it's not illegal.
