Violation of Soldiers and Sailors Civil Relief Act


My husband has an "alleged 7yr old. He has been active duty military since 92' In 96' there was a hearing Kansas because BM stated she was not getting CS my husband ended up paying all the money back to the state for the judgement. During the hearing they determined he was the father based on the fact that he signed the Birth Certificate. My husband was on a ship at the time and now we are going back to court in CA because she received state aid and child support at the same time and lied about getting the child support. We know the child is not his and need a DNA test the only way to get it done is by getting the judgement in Kansas over turned due to the violation of the Soldiers and Sailors civil relief act. Does any one know what our chances are of getting the judgement overturned? Also what liability will the courts of Kansas have for violating his civil rights? Will they have to pay my husband that money back?
