Waiting Period to Remarry


What is the name of your state? Tennessee
Can you tell me if there is a waiting period to remarry after a divorce is final?

crazy how long divorce takes sometimes isn't it??

here's info you're looking for...

Tennessee

Prior to 1/30/70, the defendant in a divorce action who had been guilty of adultery could not marry the person with whom he/she had committed adultery during the lifetime of the former spouse. A marriage in Tennessee or in another State by a person so prohibited from remarrying would be held to be void by the courts of Tennessee. (See GN 00305.160D.) This restriction had no extraterritorial effect; therefore, a marriage entered into in a State outside of Tennessee in violation of such prohibition would be considered valid by other States. (See GN 00305.155 for validity of remarriage in States which have adopted the Uniform Marriage Evasion Act.)

After 1/29/70, there are no restrictions against remarriage. Generally a divorce decree does not become effective until it is recorded in the minutes of the court.

well, if you live where i do it does !!!

my final paperwork has been sitting on the judge's desk since january 8th.... still has yet to be signed by him.. not that he won't... there's nothing difficult in my divorce... but, they just drag their feet when it comes to decrees... (like we haven't waited long enough!!)... i'm not sure about tennesee... but, i'm pretty sure you can call your county's prothonotary's office... and just tell them you need to know your "date of divorce"... they'll let you know if its been signed by the judge and final....

do a search for your county's prothonotary's number and give them a call.... they'll have a copy of it too !!

Thanks for answering so promptly. If the divorce has been listed in our daily newspaper, does that mean the divorce has been finalized by the courts?

i'm not sure ... they don't "list" them here in the newspaper... i would imagine that it is final if its in the paper.... BUT.. to be sure, i'd call the prothy's office to make sure.... just tell them you need to know the date of your divorce.... (act as if you already know its final)....

Thanks again! I would like to ask you another question, if it's okay? In the final decree it was stated that my ex was to pay the mortgage on our home until it is sold (he lives there)...I was to help (no $ figure) if possible (I pay rent). If I don't help and he defaults what are my options?

i would imagine he would be in contempt of the decree.... not sure what your options are... as far as you moving into the home or selling it immediately..... ?? if you're still on the mortgage, then you are a responsible party in the bank's eyes..... if it were me... i wouldn't trust that he was going to pay it and want my name off of the mortgage/deed.... but, you can only do that if he refinances... and i guess he's in no position to do that..??

we took care of all that stuff over a year ago... i got him off the deed and mortgage and I refinanced in my own name.... this is what i'm so up in arms about over it not being final.... EVERYTHING is final except this stupid piece of paper....

i did just hear from my attorney again today.... she said that she doesn't want to "make the judge angry" by calling his office again... BUT, if the decree isn't signed within 2 weeks... she will draw up another one, and make an appointment to have the judge sign it ... (not sure if i believe her... but, at least she called back)
