what can i do....What is the name of your state? Ohio I am currently married with one child and another due in Jan. My husband moved out 2 years ago and 2 months ago said he wanted a dissolution. I now know the dissolution is because he has a girlfriend. I have no problem with the dissolution as I do not want to be married to someone who would cheat on me. The problem is we can not get a dissolution until the baby is born. Now to complicate things more he enlisted in the Marines and leaves in 2 weeks for boot camp and with everything he will gone for 4 years with short leaves. Is there any kind of paperwork I can have filed to prevent him from removing our son and the new baby (when it is born) from the county I live in. Since he hasn't kept in contact and has made several trips to another state recently I fear he may try to take the kids and hide them with his family in other states. He also has no car insurance and his car breaks down a lot so I would feel my son is safer not riding with him. I know I can't file Legal Seperation paperwork because I have to file divorce paperwork with it and I can't do that since I can't get divorce until Jan. Any advice would be appreciated. All the lawyers that I have found locally charge for meeting with them even to discuss the case and I don't have extra money to spend since he left me with no job, pregnant with complications, a toddler to raise and now no support. |

| Sorry, why can't you just file for divorce right now? Dissolution is just another term for divorce. Why are you waiting for when it suits him and when he's long gone? I have heard of many that have filed for divorce while pregnant and never did they have to wait until the baby was born!! He has been living the high life by still seeing you(unborn baby obviously concieved AFTER he moved out) AND having a girlfriend. Just do what you have to do, nevermind what will be in his best interest. |

| Many states will not allow a divorce to become finalized when the wife is pregnant, AHA.

| Sure. But the divorce will not become final prior to the birth of the child, and possibly a paternity determination.

i was told....In the state of ohio no divorce can be granted while the woman is knowingly pregnant (I have heard of woman who are in first trimester getting a divorce before finding out about the pregnancy). And I was told that you can't just file a legal seperation without divorce/dissolution paperwork with it. I plan to file as soon as the baby is born but by then he will be out of state for 9 months in training for military before he gets a 10 day leave. He will not meet the new baby until that point. I was trying to find a way around it but there is nothing that can be done that I have found so far. Just want to keep him from taking my son and hiding him before I can do something about it. |
