What do you think I owe?


What is the name of your state?Louisiana
Hi, I am in Louisiana and my question is kind of a long one. I hope this is the right place to post this.

I bought my home from my mother while I was dating my future/now ex-husband. It was bought with my own money and I have the paper work from the attorney that took care of this.

Two years later I married my now ex-husband. After only being married 5 years we refianced the home to pay off bills and fix up the house some. This company put me as the owner and him as as co/signer. Less then a year after this he moved out. The only house payments we made together was in that little less then a years time.

Two years after he left I divorced him. I didn't have the money to get a great lawyer so the only thing it says is, "we are divorced, my child is with me and he pays me child support." Nothing more!

He informed me the other day that he wants me to get his name off of the loan and buy him out. He is claiming he should get half of this house. I have done major improvements on the house "new roof, re-did bathroom" since he's been gone which is over 5 years. The improvements were done with my own money, nothing from the morgage. I am still paying notes for these improvements.
He has remarried and lives with his new wife in her home, which is as nice as this house. They want to buy a new house and they need more money.

I am on Social Security Disability due to a serious injury, so if I were to have to pay for a lawyer or refinance my home, I don't know if I could.

I went to a lawyer the other day and he said, that everything looks good and it's all in my favor. He also said, that my-ex may even owe me money since I continue to pay off allot of his and my old debts with the new house note. The lawyer told me to just sit back and wait for my-ex to come after me.

I hate not knowing what will happen. This is the only home my daughter has ever known and my oldest child only has 2 years left of high school. They are both on honor roll with straight A's and I don't want anything to go on that would mess them up in school.

If anyone has any knowledge of this type of case, please help ease my mind. Do you think my lawyer is right about this?

The property TITLE is in your name alone and the divorce decree is silent as to his right to any interest in the home?

If so, I don't believe he has any claim. The divorce is a done deal. If he is not on title you could refi him off and not be required to pay him anything. And technically, you are not required to refi at all, although doing so would have him out of every aspect of the property. At this point he only owns an obligation for the debt.

Thank you Nextwife for your knowledge and input.

I am hoping he just leaves me alone. He seems to think he is owed a lot of money, all of a sudden after 5 years.

It seems like someone is blowing smoke up his butt or something. He is coming across as if he has talked to a lawyer already, but I am sure they only know his side of the story. I am also pretty sure he doesn't have any type of paper work so they would not of seen the house is in my name and he is only the co-signer.

I'll continue to hold my breath and see what happens.
