What if NCP moves out of state??


What is the name of your state?

Massachusetts

What are my rights if NCP moves out of state? I would have to give permission for him to take our child out of state so if I don't than he would have to visit her in my state, please correct me if I am wrong.

Depends on


your custody paperwork and your state laws in general. Usually, courts do not let NPC's take off out of state, and at the moment, IF your paperwork is in accord, then the NPC still has to come to visit.

The only thing our order says is reasonable visitation by reasonable notice to mother. I asked at the time if he could take her out of state without my permission and the lawyer from Dept. of Revenue said no. Custody arraigment is I have sole physical and we have joint legal.

Then..


with you having physical custody, no. Do you think he would take him out of state and keep him? I'd call your attorney and see if there's anything else you could do.. flight risk, etc.
