What is the name of your state (only U.S. law)? Wisconsin

Im not sure but I believe the judge gets to decide, we both want the house,
I bought it before we were married, the loan and deed are only in my name.

I reside there now, my husband left and is staying with friends.

Does anyone know how it is determined who gets the house?

He is entitled to half the equity that accrued during the marriage. You will be awarded the house.

The house is yours. As OG stated he will be entitled to 1/2 of the equity that accrued during the marriage, so you will have to find some way to pay out his share to him. That could mean a refinance, or it could mean dividing up other marital assets more in his favor.

Of course you have to be sure to state in your paperwork that you purchased the house before the marriage and that the loan and deed are in your name only.

We have been only married a year so, atleast I dont have to move my kids out, thats fine with me Ill pay him what ever hes entitled too. thanks so much

Ill have to go check with my bank on all that fun stuff, I never though we'd be getting divorced, we were friends for 13 years too, sometimes you just dont know.
