Question

Wife Not Responsible for Medical Bills?

My husband passed away last year leaving me with a few thousand dollars in medical bills. We had no medical insurance and no life insurance.

A collection agency contacted me yesterday to arrange payment for one of the bills. After I told her that my husband had passed away last year she said that I didn't have to pay it because the wife is not responsible for medical bills according to Arkansas State law, the husband is responsible for paying them. All I had to do was send a copy of the death certificate so they could clear their paperwork.

My question is - how do I find reference to that law?

I asked the collection agent but she couldn't tell me. She said it was one of the things that was taught to them as collection agents - she was very clear about it being a law and not just their policy.

I'd like to find that law because the larger medical bills are in the hands of the hospitals attorney, I've heard that he'll do almost anything to collect and he isn't terribly honest.

If I could give reference to that law rather than just a "someone told me" it would help a lot, I can't afford a lawyer right now to fight the hospital's attorney and since there is a law saying I'm not responsible for my husbands medical bills I shouldn't have to fight him.

How do you find laws? They should be available somewhere, we're expected to abide by them - we should know what they are.

Right now, if I could just find the reference to the Arkansas law that says that the husband is responsible for paying the medical bills I'd be very happy.
