my wife has requested that i leave our jointly owned home in pennsylvania. she refuses to seek marrital counseling, or try in any way to reconcile. she does agree to a joint custody type situation with our 3 children, and has been very cooperative with this. if i leave could i be brought up later on charges of abandonment? could i draw up a simple paper stating our present agreement including that i only left at her request, and with the main interest of not upsetting our childrens life any more than it has to be, and have both of us sign it and would this hold up legally?
at this point we have agreed to handle the financial matters, and i continue to help pay our mortgage, and of course child support. i am not abusive to our children or her. i'm not an alcoholic or drug addict, and as far as i know there is no adultry involved. would appreciate any help or suggestions.

My response:

Sure, it couldn't hurt to put something in writing along those lines. However, by filing for legal separation or divorce ASAP would accomplish the same thing. It sounds like you need to do this anyway, so why not seek the assistance of a Family Law attorney today ? Most Family Law attorneys will give you a free initial consultation.
