Will New Hubby Need to Put My Name on House Deed?


What is the name of your state? Ohio

Is it neccessary for my finace to put my name on the deed to his home or do I automatically become part owner once we are married? Are there legal benefits to having my name (or not) added to the deed?

It is "necessary" if you want to be part owner of the land. There is nothing automatic about it.

Anyway, if y'all get a loan on the house (for example) the lender may want you to sign the mortgage/deed of trust and/or promissory note even if your name is not on the title to the land.

Why would he want to do something that would turn a separate property into marital property?

there is no reason either legally or otherwise, for him to do so.

Sorry for being an "idiot" but why would there be no reason legally or otherwise for him to do that?

Because it's HIS property. You do not marry into the property.

Although Ohio is an equitable distribution state, separate property remains his throughout the marriage unless somehow transferred to marital property by some means.

And even the commingling of separate property with other property of any type does not destroy the identity of the separate property as separate property, except when the separate property is not traceable.

In other words, when hubby passes, he may want the land to go to someone besides you.

BTW, isn't this something you should be discussing with hubby instead of on an internet forum?
