What is the name of your state? California

Long Story Short.

My boyfriend's Childrens mother has put him in jail with a false accusation of domestic violence, He didnt do it I was there. BUT he was on parole, so hes being detained. Two days ago she filed a restraining order against him and he was served the papers in Prison. The court date for the restraining order is on the 13th of November. He has been in there since the 18 of September awaiting a hearing. He most likely will NOT be able to attend the Nov. 13th court date concerning the restraining order. I know that if one party does not show up to a court date the other party wins. How do I go about this? Do i need to get a letter notarized explaining the situation. Would they extend the hearing? Post Pone it til hes out? Or will she win because he is UNABLE to show up? Any info would be greatly appreciated. Thank you.

Why do you think you have to do anything?

Will the prison van be able to pick him up and take him for an appearance in court with his neat bracelets?

Well hopefully after the prison van picks him up, the short bus can pick you up right?

Well how nice would that look anyhow, showing up to family court in BRIGHT orange to fight a restraining order she has against her and her children.

Hes better off getting it postponed correct? I need to know how to go about that....getting it extended......

Nope they kicked me off the short bus last year and I am still filing appeals...

But thank you for making my point about YOUR boyfriend in his nice ORANGE suit not making a good impression.

I am definetly not impressed one lil bit. Why should the court extend anything so it all fits just so in your little world? Maybe if you beg and plead that he is in jail and you really, really, really want to extend it because he wants to wear a nice suit to make a better impression. Who cares what he wears, he presents his defense, she presents her case the judge decides....no fashion show involved.

You're very welcome dequeen, dont mention it. But anyway when you have something SEMI intelligent to answer, then please do so, until then keep your One Flew over the Cuckoos Nest comments away from my post. =)

So Im assuming nobody knows.....Ill have to hire an attorney I suppose, one quote was 5 grand, a little steep but managable. This means I wont be able to bail his orange suit, bracelet wearin butt outta there. ; )

I didnt read this part, guess Im the short bus rider eh'? Well when they served him the papers they said he COULD NOT show up. And I called the facility where hes being detained and they said whatever court this is being held at needs to put in a request to have him come down in the nice pretty van. So the only option IS to get it extended, and I dont beg and plead, I dont have your habits, thanks anyway.

And whether you'd like to believe it or not, impressions matter. A caucasian male in a suit is so much different than a Latin man in his "blues."

ummm i was just wondering what the race has to do with the appearance issue? are you saying that a latin man in a suit wouldnt be as good to a judge as a white man in a suit? im not latin or anything but, still sounds kinda racist...

Im just referring to impressions which may involve gender/race/appearance. Im Latina, and I have been a victim of racism when involving the law, I know it exists, and I also know that whether we'd like to believe it or not, its reality.

Not only am I but so is his family. I dont wipe my @ss with twenties if you know what I mean. Plus I dont recall asking whether or not it was a wise investment, if I was borrowing the 5K from you then you can tell me how to manage my money until then, Id prefer you didnt. so ket me bask in naiveness (is that a word?!) and stupidity. ; )

Ask yourself this dyinginside, if you cared about someone and knew of their innocence, wouldnt you do the best in your power to help them? Or maybe you wouldnt, but everyone is different in their approach and in the way situations are dealt with. If my "FELON" boyfriend were in jail right now due to actions of his own, I can guarantee you that at the age of 22 I know better than to even be posting on a message board for help. I would let him rot.

if they were ACTUALLY innocent, yes i would do whatever i could to help. he may be innocent of one thing but you said the reason he wouldnt be able to show in the first place was cause hes on parole?how innocent is he in general then?thats all im trying to say
