Would this be considered Date Rape???


What is the name of your state?Alameda county, California.
My Girlfriend was enticed by annother guy when she was 19 and he was 19 to come to a party he was having in september 2003.... she went thinking it would be ok. this guy had about 15 friends over and they got her to drink some tequila. since she had never drank before she got drunk after two shots. the guy who invited her to the party brought her to his room and preceded to have sex with her. the whole time she was to drunk to understand what was going on. Then a friend of the guy who had the party took a sexually explicit picture of her genitals. This friend eventually brought her home but not after having sex with her in his car before he did.
this was something that she did not want to do and she couldn't stop it because she was to intoxicated. i know that this was a long time ago, but she never got any support from her parents and just opened up to me about this recently. I want to know if there is still anything that she can do about this legally. we know where the guy worked at the time and since the bussiness should keep reccords of employment i am sure we can find him through them, even if it does take a court order.
On a more personal note, she was a virgin untill that night and it wasn't fair that they take something like this away from her.

Well if she said 'no' for them to stop what they were doing, yes it probably is date rape. But this happened 2 years ago. It should have come out a long time ago, it might be hard to press charges now. But I'm not really sure, more then likely that wasn't the first time those guys probably had done something like that, so that maybe something to go on.

Your friend should have reported it immediately. Although it is not too late to report the incident, there is no proof that anything happened except for her word against the other two men.

I would suggest you tell your friend to seek counseling and if something like this happens again, to immediately report it.

Another one of my pet peeves: the phrase "date rape". That makes it sound less harsh or maybe it was the girl's fault because she was on a date.

She's suffering from trauma. Make her seek help.

Also, has she reported this to the cops?

SJ, this thread is more than a month old. I doubt seriously if the poster is still around. The fool Lewcifer has been going into longdead post and reviving them with nonsense.
