5150


What is the name of your state (only U.S. law)? California

Hello,

A friend of mine, about 6 years ago, was having some trouble and so her family dropped her off at the local mental health facility. She was accepted on a 72 hour. After the hold was over, she was held for 2 weeks on a 5150. During that hold, she was given a medication thatshe believes was not quite approved by the FDA yet. Her mother gave them permission to give it to her.

She has been expeirencing side effects ever since. Now when she is tired her leg "twitches"

Does she have a case against the doctor or the place that gave her the medication? is there a statue of limitations?

This is a normal reaction to fatigue.

How old was she at the time?

5150 is a involuntary 72 hr hold

5250 is a two week extension on a 5150

I work psych in-pt and that would NEVER be allowed to happen

I believe she was over 18 at the time. I would have to find out exactly from her. this happened before we were friends. One would think that it would not be allowed to happen. but this is what she told me.

If she doesn't even know what the medication was, then what makes her think it was something unapproved or experimental?

Her mother would have NO say in the deal

She can request her medical records from that time, and have them
reviewed by a independent third party psychiatrist. The records will
state what meds were given
