7 year old dies 2 hours after leaving doctor.


What is the name of your state (only U.S. law)? WI

Hi there, my friends 7 year old had H1N1 and was getting over it, but a week later showed problems with it again. So mom took him to the doctor and he was diagnosed with pneumonia, prescribed some drugs and sent him home. 2 hours later he dies in his mothers arms. Do you think there is any malpractice here? I mean who sends a 7 year old with pneumonia home?

Impossible to say without more details. Pneumonia can progress very quickly so it might not have called for admission to hospital earlier in the day. Parents would have to get the records reviewed by an experienced malpractice attorney to know anything for sure.

As stated it's impossible to tell - was the final diagnosis viral or bacterial pneumonia (it could have been either)? What were the child's symptoms? What were the drugs given? These are the questions that will need to be answered.

Pass on your condolences and have your friend consult a medmal attorney to review the records. That's honestly as much as you can do.

Thanks guys, I will ask the parents as carefully and respectfully as possible and get back with more info. I don't know all the answers, I didn't want to pry in such a time of sadness for the family.

It's a tragic occurrence and their grieving must be the priority. If and when the time is right, by all means approach the subject if you are asked - but if they remain silent please, for their sakes, don't raise it yourself. You're obviously a good friend to them - they'll need you now more than ever.

(I've lost both a child and a husband - I'm acutely aware of the pain and they have my heartfelt condolences too)
