Arbitration Agreement


What is the name of your state (only U.S. law)? California

I signed an arbitration agreement before having some dental work done. However the dentist did not sign the agreement. The work turned out to be substandard to say the least - a healthy tooth was extracted and I will have to have $20,000 worth of work done to correct the various problems. It's a nightmare. I have therefore started a suit against the dentist. Due to the fact that the dentist did not sign the arbitration agreement, is this agreement still legally binding? When I asked his assistant about the fact that he hadn't signed the agreement (after all, it seemed to be an agreement between the dentist and me), the assistant said he never signed those agreements. So I want to know if I will have to enter into arbitration or if I can proceed with the suit under these circumstances?
