Bad case of Veneers

I found out this last Monday that Im going to need three quarter lumminers now, because of the amount of tooth structure that was left. I asked for a copy of my dental records so I can get a second opinion. They told me that I had to have a written letter to release that info. They asked why I wanted a copy of my records, and I told them that under Health and Safety code section 123110 they had to supply me with the info, including x rays and other data. The office worker got the office manger and asked me again, why I need my records. She said that she could fax over the info to the dentist. At this time I knew she was on to me and knew that I was getting info together for a law suit. I told her that she doesn't need to know. She told me to send a letter the bright now Inc, and they would get back to me within 30 days. Don't they need to supply me with the info on spot? I was aware of a fee to make the copies, but she just passed me off to a 800 number.
In Ca., and it may be in other states there are code sections about records being given to patient when requested, and the right of the office to charge an appropriate and reasonable fee for the copying charges.

The fact that they are not being very reasonable leads me to question what is going on, but I have a suspicious nature and have seen alterations to records with the intent to deceive, which is a serious violation of the professional code.

I took your advice berry and found the website. I'm getting some info together to send to him, before he takes my case. I was wondering if you ever heard of this group? I just finnished the letter and I'm sending $15 to cover the copies and postage. I'll play there game for now, but in the end I know I'm going to win. LOL

OP, the Dentist has 30 days ("reasonable time") to get you your records. Expecting the staff to drop everything to provide you copies of your records immediately is unreasonable.

Call the 800 number provided by the office and follow their instructions. You will need a written request and will, most likely, have to include the copy fee with that request.

Since you've already let them know that you intend to sue them, even though they have told you they intend to do everything they can to fix their mistake and make you whole at no additional cost to you, I wouldn't expect them to do any more then the law requires to help you build your "case". I wouldn't suspect them of trying to falsify anything without at least a little evidence of same, but I WOULD expect them to take the full time that the law allows them to take in getting your records together. That's what happens when you act in bad faith and try to get more then you deserve - people stop wanting to cooperate with you and help you.

I don't know why his records would have been moved off site so quickly. That doesn't strike me as prudent, or reasonable.

And while an office may take the time allowed, I go back to the simple issue, if you or a loved one needed their records, would you accept having to wait 30 days. I don't care if they are worried about lawsuit, or anyother reason, it is not in good faith to comply quickly.

And if I were to handle such a case I would make a note of this time delay.

As to patient whining. If one has not prepared veneeers, and fully understands the preparation necessary, the usual lack of tooth reduction for veneers, (go back to proper preparation), reducing a tooth in excess can create multiple problems.

If I were to look at this case I would also want the pre-op study models, the laboratory wax up done prior to the case starting, the final models and any and all diagnositic models that were taken in preparation for this case.

I would then be looking to have a specialist review all the models and see if the case was over prepared, and again would be extremely concerned that the final result may be a cause of ongoing and continued periodontal problems if the margins are not properly prepared.

This case just gets more and more interesting to me.

I'm getting kinda tired of defending my self to some people on the site. Yes, I did join to get valuable information to possibly per sue legal matters, and I know I'm going to here read things that I dint agree with, that's a given. But don't tell me I'm acting in bad faith! That's a slap in the face for someone with my character.
I spent months on the phone with five different supervisors from Bright Now Inc. I've had to comely explain myself, and the experiences with the rude and incompetent Doctors and staff...five different times.
So you see, I'm cooperating more then most people would do in my case,
except you...ecmst12. In fact is wasn't until a little over a month ago, the deistic manger called me and wanted to help! My gum problem may of never been a problem, if the issues were taken seriously a long time ago?
So am I really whining?
Put your self in my shoes, I'm serious, really try and then ask your self...am I whining?
I'm not out to get anything more then what I deserve. On a personal level, I been through hell and back this entire time. I'm not expecting everyone who reads this case to agree with me 100%. But dont log on and comment my Forum inless you are open minded!

I have noticed, in regard to your comments, that some people that respond are not really responding to the question, but often looking to score points. My philosophy has been to always accept what a poster says, with the caveat that I would always have to review the other side. my responses are based on many years of practicing dentistry, as well as serving as an expert witness and consultant on cases that have ranged from civil to dental board and even criminal actions.

I am open minded and I understand you are upset. I agree you probably received sub-standard treatment. What I DISAGREE with is your insistence that you deserve more then simply having your teeth fixed and your gum disease treated at no cost (which they already agreed to do). As it stands right now, you have no proven permanent damages. If it turns out once everything is fixed that there ARE damages, then you might have a case for monetary compensation, but it is definitely premature for you to be gearing up to sue right now. And you've gone and put the office on the defensive, which will make it harder for you to deal with them to get your continuing treatment. I really think you should reconsider your strategy at least until you've gotten everything you need from the office and you know whether there will be any lasting ill effects.

The OP would do well to hire (pay for) an attorney to gather the information and review the claim for merit BEFORE the OP muddies the waters so much that NO attorney will consider becoming involved should a viable claim of medmal develop.

10/8/08 (Today) About a hour ago I left the Dental office in Fontana. I went to there office to have my new permanent three quarter lumineers put on for one last time. I want to tell you that it was a great experience...BUT NOT WITH MY LUCK, The new Lumineers look almost exactly like my original teeth did, 16 months ago before I went into the Redlands Dental Office...I let the Doctor have know how upset and deeply unsatisfied I was ( pissed the F off). I asked him what the hell happen? Looking at my pictures and email I sent to him regarding the shape and color for the new Lumineers. He decides to blame in on the Dental Lab where the Lumineers are made.

So now I'm at square one all over again! He's tell me that I should take a trip to Santa Maria CA where the Lumineers are made, and have them do the prep work there. That way there will be no miss communication...I told him: You know what? That's funny you say that, because I wanted to go see the Lab myself and talk with the Lab Tech a month ago. But your office manger said i could'nt!

He was like DUHHHH?????
I left....with out the cleaning and the Zoom treatment, told him that I wont be calling back to schedule a appointment!

I still doing my homework on finding a successful and prestigious personal injury law firm!
Has anyone heard of: Law office of Masry & Vititoe? or Dane Levy?

I have heard of Masry, and have coresponded with him in the past and I have met with Dane in the past to review a very interesting case.

My impression of the two is that one might deal with much higher profile cases, and one might be more receptive to your case. That is the nature of legal, no matter the merit, some cases don't generate a return to make it worth the time and effort.
