for about six months now, my wife has been suffering from severe headaches, she has visited our family physician at least 8 or 9 different occasions. after the second visit she and I suggested an MRI but the doctor seemed to think it was unneccessary. He simply medicated her and sent her on her way. EIGHT DIFFERENT PRESCRIPTIONS LATER, and after suffering 5 months of headaches , the doctor finally decided to send her for an MRI.
When the results came back, he told my wife that a spot was found on her brain....but not to worry. He said he was going to get a second opinion and get back with her ASAP. After two weeks passed, we called him, only to get the receptionists who made excuses for him, and promised that he would call later. HE NEVER CALLED! after several unsuccesful attempts to contact him, we decided to change doctors. we currently have an appt. at another doctor.
ITs been over five weeks, and we still havent heard from him. ITs almost like hes avoiding us!!
we also have an aquaintance that used to work at the doctors office as a nurses aid, and quit her job because she said that the doctors and nurses talked about people that came in and made stories up just to make certaion people wait ((people they didnt like))

do I have any kind of a lawsiut

Just ask that the MRI results be sent to your new doctor and have him/her go over the results with you to make sure nothing abnormal is going in your wife's brain.

If this is your PCP ordering the MRI and not a neurologist, your MRI will be read by a radiologist and there will be a report and it will say something more than that you have a spot, it could be an artifact or a normal occurrance, that may be why the doctor has not responded. Since the doctor has been unresponsive call the lab where the MRI was done, explain that your doctor t
Plold you the MRI was abnormal but has been unresponsive to your inquiries and your wife has had headaches for more than 5 months. Ask to speak to someone who can interpret the results and give you an appropriate referal. Also ask them to send you a copy of the test report.

Please post back with your results.

Your wife is the only one who potentially has a medmal claim. Unless you have been damaged in some way by the physician's negligence, you have no reason to sue.

Does your wife have a potential claim? That depends on whether or not she has suffered significant damages that she would otherwise not have suffered and that depends on the true diagnosis and treatment, both of which are still unknown.

Your wife should get the MRI film from the hospital and take it with her to her next doctor's appointment. The physician can look at the film during your wife's appointment.

Once you know if your wife's condition is something that could have been treated at the time of the MRI or earlier if the physician had ordered an MRI in a timely manner, post again and tell us what you found out. Then, we can provide our opinions based on the required elements of a medical malpractice suit. If your wife suffered significant damages as a direct result of the failure to receive an MRI in a timely manner or to receive medical care promptly after the MRI, you can skip posting to us and contact a medmal attorney in your area.
