Did the docter get a free peek at my naked Girlfriend?

What is the name of your state (only U.S. law)? WV

Nearly 3 weeks ago, my girlfriend and I both needed to see a dermatologist for skin redness. We had the same symptoms and had a good idea we may have had the same reaction to something. My girlfriend went the day before I did. The doctor asked her basic questions about the symptoms, then told her to undress completely naked only leaving her panties on. He gave her a normal medical gown and left the room. After returning, with no female nurses in the enclosed room, he took skin samples from her vaginal area, her stomach, and her lower back. She felt very uncomfortable because she has only been seen naked by female doctors for apparent reasons. He diagnosed her and treated her (which the treatment still hasn't worked). The following day I had an appointment with the same male doctor. I told him my symptoms and he asked if it were my girlfriend who was in the day before, I told him yes. He then took skin samples from my wrist, and my stomach. He never asked me to undress. He left the room to I.D the skin samples and returned diagnosing me with the same skin irritation. He even told me the skin irritation we had would probably effect my testicals more than anything because of the heat in that area. MY PROBLEM IS, he never had me undress to take samples from my testicles(not that I wanted him to), or even my chest. My girlfriend is very shaken up by the fact that she had to get naked, and I didn't. Shouldn't we both have been treated the same way especially if its for the same diagnosis? Or did the doctor just want a free look at a naked young lady? I would hate for him to get that sick satisfaction any more than he already has. What is the name of your state (only U.S. law)?

If your girlfriend is uncomfortable with a male doctor she should ask for a female doctor. As long as he didn't touch her inappropriately then you have no legal remedy.

I am sure that the doctor did not ask her to undress or examine her private areas purely for his own amusement.

For curiosity's sake, what damages would even you be seeking?

Of course it is! I'm quite curious as to what the OP's legal concern is...

there are lots of cases of doctors taking sexual advantage of their patients, and the embarassment of the patient, leading to a lack of reporting of such behavior.

As to the question raised, if would be interesting if his girlfriend were to find a female doctor, report the same symptoms and see how she would be treated.

Although I think it's foolish for ANY Physician to do an exam without a witness, it is not required. How do you propose he properly diagnose the "irritation"/rash without viewing and obtaining scrapings from the affected areas? If she kept her panties on, how did he get a sample from her vaginal area?

If he was able to confirm the diagnosis by the skin sample he already got from you, there was no reason to take additional scrapings.

From the symptoms you describe, I strongly suspect I know what kind of "irritation" you're talking about. If it's been 3 weeks and you're not seeing improvement, you need to call the Doctor so you can be retreated.
