| | | Do I have a case? What is the name of your state (only U.S. law)? IL
My dad had Open heart surgery last week, this was supposed to be a simple valve replacement. He would be waking up the same day, start walking the next day be out of ICU in two days and out the hospital in 5 days. During surgery at the time we were expecting my dad to be in ICU, one of the nurses came in and told us that they had a complication. As they were preparing to close him up, and removing all tubes in the heart, they tore the Aorta Arterie and needed to be repaired immediately. so a surgery that was to take 3 hrs total took 5.5 hrs. Then when his personal physician came in to see my dad, we were talking and mentioned the tear of the Arterie, for which she was surprised to hear as this procedure was not on the report that she had just read. he then started bleeding more then normal, and we were told that they could not wake him up yet. 24hrs later the blleding stopped, then he was swollen, we were told that the reason why was b/c of the bleeding the previous day he was not administered a medicine that would prevent his body from retaining do much fluid in his body. 48hrs later the Dr's decided to stop sedating him and let him wake up, when he did he was too weak to move and to breath on his own due to the faxt that his lungs were still filled with fluid,my dad remained like this for another 2 days. He was transferred to a regular room to complete his recovery. The total duration at the hospital was 11 days and he still needs to be attached to oxigen.
Any ideas? |

| | | Until you know what, if any, permanent damages he will suffer, you will not know whether he has a viable malpractice case. He can, however, consult a lawyer now to evaluate the strength of any case for negligence itself. |

| | | In addition to the advise ecmst12 gave you, let me just add that there's nothing "simple" about heart surgery, including valve replacement. The fact that he was going to be in the INTENSIVE Care Unit for a couple of days post op indicates it was more than "simple". Your father also signed an informed consent before his surgery. Because of the proximity of the aortic artery to the heart, I'd bet the risk of aortic tear was included.
Hope your father continues to do better.
