on July 25th 2005 I ruptured the tendon in my left thumb. In 2005 and 2006 I had four surgeries with no success. After the third I lost the feeling in the first two fingers. A fourth was performed withont any relieve. I lost the feeling in these fingers, grip streight and about 50 % of the use of my left hand as a whole. In the last 12 months I have lost almost all the use of my hand. I saw another surgeon who on Sept 2, 2009 went in and put a medial nerve graf in and repaired the ulna nerve. I am left handed and will require more surgery. The present surgeon states that the nerves were damaged in one of my other surgeries. Is there anything I can do now? What is the name of your state (only U.S. law)? |
If I were to review a case, where the same doctor performed multiple surgeries without success, and then referred a person to a new doctor who got results, it poses the interesting question of whether or not the first surgeon was treating in an area beyond his expertise. But the burden of proof is on you to show that the first doctor was below the standard of care in treating you. What did the second treating doctor tell you about the problems that you encountered? Is he willing to state that the previous treatment was below the standard. Was the first doctor a specialist in the area of treatment?
I know that when I had hand problems and needed surgery I was referred to a specialist that only treated hands.
