Doctor offices refuse to release personal medical records

What is the name of your state (only U.S. law)? Massachusetts

I was in a mva in 05 and received injuries then. Suit already settled about mva. During treatment years ago I allegedly receive a diagnosis of CIDP then.
GBS/CIDP Foundation International, majority of doctors have not even heard of my condition. Their is no cure, no remedy only remission. It is an autoimmune disorder, my body is attacking itself.

The doctor who diagnosed me then abandoned treatment and refused to send my attorney those medical records even though i signed releases. I had two forms of insurance also. That particular doctors office of nashoba has lost, i meant misplaced my medical records to this day. I am also still waiting for them to call back to schedule an appointment. I have an appointment in five days at umass which i personally scheduled. I can prove everything I have just declared in this page in proper documentation.

My questions are

1- Can a doctors office refuse to release medical records? I do not owe them any money and i think it is MGL ch.111s70e they are violating.

2- Can a doctors office refuse to send my personal medical record to my personal attorney even though i signed releases?

3-Can a doctor diagnose then abandon a patient?

4-Can a doctor hide my medical records from my attorney and I due to their negligence, incompetence or medical malpractice?

It may be hard to conceptualize how a breakdown may occur in our healthcare system such as this. I am 26 years old and have CIDP which causes me to be permanently disabled and fully thank any and all doctors who have refused to treat me due to my disability and continue to this day deny responsibility.

Why would your attorney need your medical records? Especially if your auto accident case is settled?

If your records have been lost, then they're not refusing to release them, they are lost. Which is of course a problem in itself, but they still can't release something they don't have. Have you made a complaint to the HIPAA board?

They cannot withhold your records for nonpayment of an account balance. They can withhold your records for nonpayment of fees charged for copying/reviewing them.


2- Can a doctors office refuse to send my personal medical record to my personal attorney even though i signed releases?
Generally, no... but did your release state ALL medical records or just the ones referring to your MVA?

3-Can a doctor diagnose then abandon a patient?
CIPD is an immune disorder and unrelated to your MVA injuries. What was the specialty of the Physician actually making the diagnosis during your MVA injury treatment? Although abosultely qualified to make the diagnosis of CIPD, generally isn't treated, for example, by a PCP or Orthopedic Surgeon. Have you sought treatment by a neurologist?

4-Can a doctor hide my medical records from my attorney and I due to their negligence, incompetence or medical malpractice?
As ecmst stated, they may be lost and unretrievable. Medical records are retained for a period of 7 years in your state before they can be destroyed.

You waited almost 7 years for the diagnosing Physician to call you?:confused:

Were you actually diagnosed, or was it one of several possibilities to be ruled out given the symptoms you were having? In any event, U Mass will make the diagnosis, get you to the proper specialist/sub-specialist, and get you the appropriate treatment.
