What is the name of your state?NH
My primary care Dr. told me I had a Brain tumor and it "did not look good". He said I would never go back to work.... Then he sent a diagnosis to my Employer with statement that I have Brain Cancer and would most likely never go back to work. He offered this diagnosis before he sent me to a specialist to review the MRI. Had my primary care Dr. waited to receive results from a specialist he would have found out I had a pituitary tumor not Brain Cancer. He left my family with no hope of recovery. Thank God three specialists quickly determined I had a pituitary tumor (not Cancer at all) and 100% cure rate.
What are my legal rights for the stress he caused me and my family and the fact he sent such an irresponsible medical report out to my employer? He had nothing what - so - ever to base his "Brain Cancer" diagnosis.
Can a doctor just do that without knowing what he is talking about??

Your primary physician is not required to send you to a specialist prior to giving you his/her opinion of your medical condition. Your MRI was read by a radiologist who rendered an opinion as to the diagnosis or indicated diagnosis and whose opinion was of significant influence in your primary physician's opinion.

I've known specialists to disagree with the initial diagnosis and during treatment, confirm rather than disprove the original diagnosis.

I don't know how old you are but virtually everyone 40 years-old or more has one or more pituitary tumors; most do not require any intervelntion at all. Be careful what medical advice you accept. Surgeons operate; that's what they do. I suggest you obtain evaluation by a board certified Endocrinologist who has at least 15 years experience and then decide on a course of treatment.

Do you have basis for a lawsuit? I seriously doubt it. You would have to prove your primary physician gave you the wrong diagnosis because he/she failed to follow established medical procedure(s) and that telling you and your employer was not within the normal/usual scope of practice that is applicable to your situation. That would be only one stage of a lawsuit and it would cost you somewhere around $5-10,000 to have the records reviewed by the appropriate medical experts and to pay your attorney's fee and expenses.

Thank you very much for your opinion. I think you are correct. The good news: I have met with 3 specialist in the field (one from Dartmoth Hitchcock and my Surgeon is the Director of the Pituitary Tumor wing at Mass General. (Sorry I don't know the fancy names for these guys,... but they are the best and it is .. Thank God a Pituitary Tumor...
