In a state where spoliation itself is not tort law, does proving it help or harm a medmal case?
For example missing missing lab data that's in the records as once being there, obviously made-up descriptions which don't match reality/photos etc. Also malpractice things like doubled drug dosing.
One lawyer said they couldn't take the case because the evidence was spoliated. Does this make it a nonstarter when it should be a slamdunk? Thus can a cause of action be for deprivation of justice/obstruction of justice?
