False Urine


What is the name of your state (only U.S. law)? Connecticut

I was tested for drugs by my Doctors office recently. I am on opiates for pain and they are expected to show up but I was called Monday and told there was Weed and Meth in my urine I made a huge fuss because I have, in 35 years NEVER used illegal drugs. They retested me and now it is just the opiates. If the sample was tested sloppily or something like that and nearly being cut off and accused of this even though it was proven untrue can I do anything about the company that tested it?

No.

False positives (and false negatives) are not uncommon; more to the point though you have suffered no damages.

Did they retest the original urine sample or did you deliver a new one for testing?

ETA: If it was a new sample, what was the time period between the original sample and the new one?

less then 4 days and they had me take a new sample.

It would have been more accurate to retest the original sample.

Your only possibility...and it would have been a stretch in any event....would have been to prove the chain of custody on the original sample was breached, and exactly where it was breached. However, as Domatique already stated, you have no damages, so you have no case.

FYI...in some cases marajuana and/or meth can be out of your system within 3-4 days, depending upon the frequency of use.

Seems the most likely possibility is either the sample or the results were mixed up with someone else's. But there still appears to be no damages since the 2nd clean test is apparently being accepted.
