How do I sue Kaiser?


What is the name of your state (only U.S. law)? California

The day I received my IUD I complained about the pain that I experienced. I followed up with 2 phone calls to Kaiser advice nurses about my uncertainties and potential abnormalities about my pain. During my IUD insertion follow up appointment, no "string" was visible and I was told by the Kaiser Specialist that "it could just be pushed up behind my cervix, and that was normal." I was also told that my severe pain was "normal" during the first year of receiving such device. So I trusted Kaiser staff and endured such pain for an entire year, missing a lot of work and pay. My sex life and marriage suffered from the inability to have sex from the pain cause. I changed jobs in September of 2008 which resulted in a change in insurance. I saw my new Doctor in April of 2009 for a PAP SMEAR that eventually led to my scheduled Emergency surgery in May 2009 for removal of the IUD which was located on my Appendix! The said a no visual on the "string" is the first warning of Misplacement! My new Doc has been for over 40 years and never seen such a thing. I have a disturbing x-ray that shows the thing up-side down on the right side of my abdomen, and the Doc took pics during the removal, which by the way left me with 2 scars. I had 2 vehicles repossessed, a failing marriage, and new bad debt as a result of this.

Can I sue for negligence, lost wages, pain and suffering? If so, How?

Three items needed to proceed with a law suit.

Treatment must have been negligent, and one would need an expert to testify that it was.

The negligence must have caused you harm, which it did.

there has to be financial damages which you indicate there was.

It would be time to discuss this with a malpractice attorney.

Your new Doctor is correct. The first warning that the IUD wasn't placed properly was when the string could be visualized. A little extra time and a fairly simple check would have answered any question of placement. My question is how the heck did it get to your appendix?!? The only way that immediately comes to mind is up the fallopian tube. Very Painful indeed.

As Barry already suggested, find an attorney who specialized in medical malpractice. S/he will obtain copies of your medical record and have it reviewed by an expert who will advise further. Good luck.
