Kaiser v. me v. geico


What is the name of your state (only U.S. law)? Colorado

In march of this year I was the rider in a car that was rear ended. My back hurt so I went to urgent care and recieved treatment. Some x-rays, muscle relaxers and I was fine the next day.

In may I recieved a call from Geico. The rep wanted info on the accident and to know what kind of medical treatment i recieved and how much it cost. I told her my co-pay was $50. Later I recieved a check for $50 with release papers. I cashed the check but did not sign the papers.

In September I was contacted by Health Care Recoveries for Kaiser Permanente. They said they were trying to find out who was responsible for the medical costs and took down what little oinfo I could give them. I told them that my friend whose car I was in had all the info and gave them her number, they never called.

Just this week I recieved what looks like a bill from health Care Recoveries for over $600. it states "...in the event you recieve settlement from an insurance carrier or other party, the plan may have the rightof reimbursement for medical benefits provided."

i am very confused and do not know how to proceed. help!

from what I gather gieco paid you your out of pocket expense $50. Now your health insurance is looking to collect for what they paid. You should direct them that you recieved no settlement but a REIMBURSEMENT for co-pay, and that they need to contact geico or whatever ins. carrier is insuring the at fault to seek money. As far as I can tell you should be in the clear, but I'm no lawyer good luck

See, thats the terminology I did use when I talked to them. Then, I revieved the bill/ notice

You did receive a reimbursement of $50 but what they are speaking of is money your insurance company paid that the other insurance company may have reimbursed to you.

Since you have received no such settlement (all you have gotten is the $50, correct?), you owe nothing.

You can ignore this if you wish although they may misinterpret it so I would contact them and tell them you have received no such settlement.

It is commendable that you did't seek legal advice and just wanted to do what was right. Seems the adage that no good deed goes unpunished is coming to you.

Send the bill to Geico. Since you did not sign the release papers, Kaiser still has the right to be paid by Geico.
