What is the name of your state (only U.S. law)? NY

There is a case going on and the physician is being sued for $10 million. He is also an employee ( not independent contractor ) of the clinic where the incident occurred. Found out recently that he only has liability coverage up to $2 mil.

Suppose we really win $10 million. Since he only has $2 million in coverage, who will pay out the remaining $8 million? Will the employer pay the rest? Or do we have to go after his personal assets?

Did you see the clinic as well?

The firm is also suing the clinic as co-defendants. But since the actual employer(s) didn't do the procedures, I don't know to what extent they will be held liable.
You need to be asking 'The firm' your questions. They know how they handle these kinds of things.
