Wal Mart gave incorrect Meds.


What is the name of your state (only U.S. law)? Ohio
Wal Mart put the incorrect medication in my wifes prescription bottle. My wife is on Opana and the pharmacy put in some type of Oxycontin. The pharmacy caught the mistake and called us after my wife had taken the medication weeks ago. I don't think there will be any ill effects because the meds were similar. The wife has a doctor appointment in a few days. Wal Mart corporate office will contact me and I don't know what to say or ask for. I hate to sue but they could have killed my wife for god sake and the mistake was not caught until well after she took all of the medication. She is on a pretty strong narcotic for her back and I wonder what happened to her medications she was supposed to get. . Anyone familiar with Wal Mart pharmacies please help me with some advice.

The district manager was very apologetic and hinted at some sort of settlement.

What are your wife's damages? You have indicated that she has no long-term problems...(or even short-terms problems, for that matter).

You don't get to sue because something COULD HAVE happened. You can only sue if something DID happen which caused damages.

They should offer to refund your insurance company what they paid and refund your copay to you. That's about it.

Just an editorial comment and in no way an excuse for what happened...

Since Walmart implemented their $4 prescription deal, and other pharmacies have followed the practice, we've noticed an increase in mistakes both transcribing and filling prescriptions from our office. IMHO, I think the significant increase in the number of prescriptions brought in, and the pressure to get them out to the customer in a short period of time is the cause for some of the errors. There have been several complaints to our state's Pharmacy Board over repeated errors by some discount pharmacies.

It just reiterates the importance for customer/patients to check the labels of all prescription medications for accuracy of dosage and name of med. If there is any question at all, return the med to the Pharmacy and/or call your Physician for verification of your prescription.
