What is the name of your state (only U.S. law)? Texas. I had a c section and was dropped off of the OR table while being transferred. I sustained a back injury and have not been able to return to work as a result. The hospital has been paying me what my salary would have been while I've been looking for a miracle cure but was told definitely that i would not be able to return to my career. They want a number from me but I'm not sure what i can legally ask for. I'm severely depressed and on heavy pain medication which brings a whole slew of problems as well. What all do i consider when putting together a number and what am i likely to get?

Take your medical records to a med-mal attorney. We cannot and should not make any guesses as to any sort of specific dollar amount.

Yes, lawyers figure out what to ask for, however it would be irresponsible for someone on an internet forum to give that kind of advice.

You are being solictied to offer a settlement figure. A lawyer can represent your interest in that settlement more competently than you can alone. You don't need to sue to have a lawyer represent you.

It is a free advice site. But in your situation we would be wrong to advise. This is something that you should deal only with an attorney.

With that said.

If it were me I would figure out what my yearly income is x how many potential years of lost wages.

How the injury is effecting my ability to parent my baby.

How the injury effects my relationship with my spouse.

Plus pain and suffering.

P.S. No amount of money makes up for the injury...For not being able to get on the ground and play with your child...I know. BTDT. :(

I took no offense - but then I'm also a person living with a couple of chronic conditions that happen to be physically disabling and actually life-shortening ... markedly so.

My graciousness and latitude is willingly extended :D
