wrong prescription


What is the name of your state (only U.S. law)? californiai received morphine from my pharmacist instead of oxicodone was on the rx for two in a half days, did contact pharmacy to inquire on meds was told they were the same rx, felt real good no pain, did way to much and have suffered this whole week do i have a case against them?

Uh...what?

Are you saying you took too much morphine and now want to go against the pharmacy? When you noticed you got the wrong medications did you take it back in and have them refill it with the correct one?

What, exactly, is the name of medication as listed on your prescription bottle? What was the dosage prescribed and how much did you actually take? Why do you think you can hold some one else liable for YOUR choice to take more than the prescribed amount?

Unless you have suffered permanent damage you really don't have a case.

Hard to believe that a pharmacist would say that both are the same.

Lawsuits need to show negligence, need to show harm from negligence and need to show a financial loss.

There are many instances of negligence being shown, but without harm or financial there is no case.
