My mom applied for a petition I-130. i had my visa interview first week of feb of this year.. last saturday MAY 2, she received a denial notice and that all the papers will be returned to her in the US by the USEM here in manila.

today, monday MAY 4, a friend of my mom who works at the USEM called me up and said that my visa will be approved but i have to take a medical exam and NBI clearance again because both these documents are about to expire.

he also told me to drop by today at the USEM to get my passport in order for me to take a medical exam again.. he said he asked his superior officer to talk to the consulate who initially reviewed and denied my mom's petition to reconsider my case and re-review my papers. he said that after the consulate re-reviewed my papers, my visa was approved and so now all i need to do is get a medical exam and NBI clearance.

this is so confusing please help

He came in using his Canadian passport. So I would assume since he came in Dec. his visitation would end in June and he would have to return to Haiti or Canada, I'm not sure.

As far as his father goes he came to this Country in 1998, I did not know him then. I met him in 2002 and in 2003 just before we were married I found out that he had paper filed to adjust his status. I met his lawyer who showed me the paperwork. But shortly after we were married, the lawyer called to tell him that his petition was denied. The reason statements made in the application. We saw a lawyer who was recommended by an immigration judge, he filed an I-130, but after researching the Visa Type and hearing the order for removal recommended that we do not go to the hearing, because there was a small chance he would be taken away. So we did not go. He told him not to leave the country because he would not be allowed back and to just wait for some new laws to pass.

As far as my stepson, I will take your advice and contact someone, because this is a big decision and big responsibility.

    Thank you for your advice.
