Thanks Gail for your reply. I very much appreciate your honesty. I have been getting all kinds of varying advice from lawyers. And I really didn't know if I was in the wrong or the right. I've been told I was constructively evicted and all sorts of things. In the end I really didn't feel safe there with the landlord/housemate's hours long rage-fit with all the yelling and screaming. So, even if it costs me 2 months more rent, at least I know she isn't going to be able to kill my cat or toss my stuff out on the lawn now that I am out. The whole experience really frightened me.

Thank you for your response Gail, I appreciate it. I did not appreciate the sarcasm of the other person posting though. It might help if he actually took the time to read the post before responding. I was unaware of the defect until I spent that afternoon locked out on my patio.

What do you recommend I do to resolve this situation? I am a good tenant and I believe they should take the proper steps in fixing this issue. I don't want to have to worry about every time I have company over or if someone follows me out onto the patio that it will lock. I think it is a serious safety hazard that needs to be addressed.

What are my rights here? Any suggestions? I have hit a brick wall with them.

    Thanks!

Thank you for posting a reply to my question, but I just wanted to ask you something else. If the tenants are relocating to Fla, do we still file the claim in the county that the house was rented, or do we need to file in Fla? Also, would we need to hire a lawyer to file the claim or is it something that we could handle ourselves?

Hi Gail. I hope you don't mind me sending you a private message. I thought that you might be able to help me more than others on this site due to the fact that we are in the same state. I posted a thread yesterday about Landlord/Tenant issues...

The tenant is now 3 months past due on rent. We have a court date on Friday. I am being told that is she pays all of what is owed on that date, she can continue to live in the home and nothing can be done to have her removed...is this correct?

    Thank you for your time,
    Stephanie
