hi ldij, you helped me with a question before and you seemed very knowledgeable and sincere, i was wondering if you could shed any light on this question

    College tuition/divorce in ny

What is the name of your state (only U.S. law)? NEW YORK

My divorce was final in 2006. One sentence read each party agrees to equally contribute to extra curricular activities. My daughter was 14 at the time. I paid half of her dance plus child support every month, until she needed braces. i had a verbal agreement with my ex that i would pay the full orthodontist bill and she would pay the dance. I paid the full $8,000 orthodontist bill. Shame on me for not putting the agreement in writing. My ex took me to family court and was awarded $7000 in dance fees.

At that time my ex also asked for half of the $40,000 a year college my daughter is not attending. The divorce only had one sentence "the non custodial parent may be required to pay certain educational costs." The magistrate threw this part out saying i was not responsible for it. However she did tell my ex that she could go back to supreme court and have our divorce reopened.

The facts are: my ex did not consult me with the choice of college until my daughter was already enrolled and the first payment was due, i then told her i could not afford it but would give her half of a state school, i also had a discussion with my daughter about not being able to afford it and my daughter agreed she would take loans and i would give her 10,000 when she graduated, there are a total of 5 suny schools that have my daughters major, my ex did not attend college, i did for one semester and dropped out, my daughter went to public grammar and high school

my questions are - how easy is it to reopen a divorce in ny to include college? could a judge make me pay half of the 40,000? and since my daughter is finishing her junior year would i be responsible for the years that have already passed? if i am can i have my child support reduced?

i make 120,000 a year and also have a 3yr old and 4yr old to take care off and i pay 1200 a month in child support. my ex makes about 60,000a year

thank u in advance for any help

Thank you for your reply. I am still a little fuzzy on this and replied back on the child custody/ support modification thread. I am hoping you can explain my last question! Thanks!

Thank you again for speaking up for me. I really appreciate it. I hope to become more familiar with the site, and I think I will just avoid those people and ignore them for now on. . You are the kind of person that should be giving advice because you seem fair and knowledgeable. Thanks again

I wanted to thank you for looking at my question in a legal manner and giving me sound not judgmental advice. I will relay the information to my future husband so he can do what he needs to and i can do what i need to for the children. Once again Thank you for being a mature adult and providing what this site is intended too.

From what i see in the comments "do i have to refinance" I would not need to refinance. I am not sure what an assumption is in the comments. This home is in a trust left to me, so can i leave it there and do i need to make changes to the title with in the year of his passing?

I have a question in regards to the "School Activities" thread. (I am writing this to you in a personal message becuase I did not want to high jack the thread and I dont have any actual legal advice to add, but rather a question to add. That and I value your advice) This lady is concerned about school activities and my question pertains to extracurricular activities. My decree states "The parties agree and understand that their rights of physical custody as herein provided shall at all times be exercised in keeping with the general welfare and best interest of the minor children and shall not unreasonably interfere with their attendance at school or extacurricular activities."
All three of my children are currently on a bowling league. They bowl every Saturday at 9:00 a.m. This has not been a problem as Dad CURRENTLY lives in the same town as us and supports the kids' activity. However, Dad is moving at the end of this month and I am not sure what to do. Dad will be living 3 hours away and with the kids bowling every Saturday, it cuts into Dads time. Dads visits start on Friday at 6 pm and end on Sunday at 6pm. This is not an attempt at finding out how to avoid Dad getting his full time with the kids but rather and honest attempt at some advice as to what to do. I have already paid the non refundable entry fee for the children to bowl and this was/has been in place before Dad told me that he was moving. The children have been bowling for about 2 months and are supposed to bowl for another 5 months. What do you suggest I do?

Thank You for your answer and understanding.
Seems that are some bitter people on this site which is sad. I looked at some of the main name caller's other messages and realized it was not just me. Since the name caller is a senior member it is not reflecting well on the site.
