Admin separation family advocacy failure


What is the name of your state (only U.S. law)? Hawaii
I am enlisted in the Navy, August 23rd of this year I will have 19 years of service. I am facing an admin sep for a FAP failure and will be having a admin board appealing the FAP committee decision. I was involved in a dispute with my now ex-wife Sept of last year. No charges were file from neither of us. My command request a FAP waiver, but COMNAVPERSCOM denied it, and want to separate me for serious misconduct. In may I was approved to go to the Fleet reserves, but earlier this month the command received a message for an admin separation. How doese title 10 chapter 59, sec 1176 apply to my situation. I had a fap case back in April of 2003 and finished a 9 week program. the incident that happened with me an my ex-wife was an islolated incident, i left my home to leave an argrument we were having and my wife at the time followed me out the house and to my car. she opened the passenger door and struck me i the right cheek, I was about to start up the car and she lunged at me again, I raised my right hand with my keys in my hand and she received a cut on her forehead, which was not intentional. Was told that i can request to be transferred to the fleet reserve, do not know how true that is.
