army reserve deserter

ok, heres my problem: i enlisted jan 2004. i actually beleived my recruiter when he told me reservists NEVER get deployed (i know, im an idiot!). i left to basic june 04 an then to ait at jackson augsut 04. b4 ait ended, i decided i wanted out. the day after i get home my SFC informs me i've been identified to mobilize to iraq later that same month. i havent so much as contacted my unit since. I know what GI rights said, an what other people have said, but being that i was supposed to deploy, does that make things different? i did absolutely no paper work since i left jackson, and still recieve LES statements for $o.oo. i do want to turn myself in and get whatever i have coming to me over as soon as possible. i just think its insanity to risk coming home to my mother an my fiance in a box over some paychecks during a war that is based on negligence and deception. especially after i learned what conditions are like for people wh live in countries who dont have much of a military (it saddens me to learn that the united states is home to 3rd wordl country conditions while a very small number of people own most of the country ) Please, if anyone has useful info i'd realy appreciate it.

Browse through the threads AWOL/DESERTER. there is some good anecdotal info there ( what happened to a particular person) and also some good general info. You might want to call the Fed. Deserter Hotline, which is located at Ft. Knox 502 626 3722/3724/3711. As I have said before, my experience with them is that they are nice ladies who can give you SOME info without prying. They will ask for the SSN of the person who is AWOL and check to see if the unit has sent them the docs necessary to have a federal warrant for arrest issued. Occasionally, an MP type answers on the above phone numbers, but still they are helpful providing info without asking alot of questions. The people at these numbers also can give you info on where/how to turn yourself in and, generally, what to expect as far as day to day life while the military decides what to do with you. They have no insight about legal matters and are quick to tell you this.

As far as being identified as deploying to Iraq, this has the potential of making your situation more complicated as there are seperate UCMJ regs regarding AWOL in order to avoid hazardous duty. There is no way to say if the military will have interest in charging you with this....Posts on this site bear out what an atty in Calif who works with AWOL/deserter cases told me: UCMJ has regs, but there is a WIDE berth on how lenient or severe the punishment levied can be. You may/may not be charged with any/all of the assorted violations. No way of telling til you go in**************.

When you turn yourself in DO NOT tell them that you knew you were going to be deployed. They will try to slam you with avoiding hazardous duty PLUS the AWOL/desertion. If they say SFC so and so said he spoke with you, deny it. It will be pretty hard for them to prove you were informed.

i think misledyouth is a misledyouth....when the powers that be look over your stuff it is going to be obvious to even the most casual observer if the unit from which you went AWOL starting making prep for Iraq or headed there shortly after your departure....lieing about your awareness of this fact probabley isnt going to fool anyone.

misledyouth's spelling of hazardous (hassardous) is indicative of the span of his experience.

You might want to spell check your own post before you flame mine for a spelling error. I'm telling you man. If they deside to go all out and try to nail your ass to the wall for deserting your unit because it is deploying (veeerrrryyy unlikely, unless you were in a bunch of trouble for something else before you left) I'm pretty sure they are going to need physical proof (like signed orders or signed notification) that you were notified. Odds are they wont, because thats going to cost the army much more time and funding and to be quite honest your not worth that much to the government.

Let's see, you joined the Reserves in June '04 and didn't realize that the Reserves deployed?

Where were you living at the time, Mars? They began Reserve component deployments sometime in early '03 or sooner. Over 18 months prior to you reporting to basic.

You gonna try and sell us oceanfront property in Arizona next?

snipes, i really appreciate that you took time out of your life to poke fun at my situation, its just shows the type of person you are (unfortunately obsene posts are prohibited). its easy for you to sit there and act like an expert on life. i dont know where ur from or what ur life is like, but living in the bronx aint exactly easy, ur not glued to the tv watching whats going on outside where ur from if where ur from is as F-ed up as where i am from. i already admitted i made a mistake (dummy, u didnt need to reiterate that, u must have a child's mentality), i didnt do any of my own research b4 leaving, an i trusted my recruiter. ofcourse after learning first hand what everything is all about, i realized it was a big mistake. as for whether or not i was ever in any trouble, in my 5 months training, i racked up 4 awards, including honor grad(fox 5) and commadant's list (ait, for having more then 98% and a good physical test score).
i'm not in a very good situation, and i dont feel my mistake was not reporting to go to war, my mistake was thinking joining the reserves was a secure way of a lil extra income and medical insurance (a lil less then half the people in the greatest city in the world are denied medical coverage). those things are real important when college isnt paying off, you dont have a decent job and unemployemnt is through the roof. the hundreds of billions of dollars spent for this war could be used nicely to provide shelter for the homeless or give all citizens at least some form of medical coverage. i honestly fit the description of a CO, but i'm pretty sure in my situation the army will determine that i don't. also, i read on another posting that the army is just gettin rid of people who pop hot on the drug test instead of jus rehabbing them. i'm not planning on going that route, i'd jus like to know if there is any legitimacy behind that claim. as for the spelling errors from the above postings: Lvn mispelled a bunch of words, including the word u tried to correct, if u reference the dictionary, you will find that hazardous is spelled hazardous (hassardous?)anyway, the way a person chooses to spell on an online posting is no indication of that persons knowledge

before i forget, thanks for taking the time to give me some feedback. as for snipes5, would u be interested in some oceanside real estate in arizona?? are u the type of person who believes ending terrorism will be reached by bombing a whole lot of innocent people?(isnt that fighting fire with fire, or terrorism with terrorism?)

Also, I would say that just because your unit was about to deploy doesn't mean that is sufficient enough for them to conclude that is why you went AWOL. Deny IT...tell them you were depressed and it wasn't for you or something general like that. You missed your /mom/girlfriend/home, etc. etc.

About Iraq....all of that great WMD evidence provided in Feb 2003 by Colin Powell was provided by a mentally unstable drunk exile from Iraq(his name was CurveBall), who when meeting with CIA officials was either drunk or had a hangover. Wow look at things now. Iraq had nothing to do with 9/11, nor were they a threat to anyone. I was there ,the whole country was a poverty-ridden slum. They probably weren't even a threat to Kuwait. Iraq is now the worlds best Al-qadea recruitment operation; the war isn't suppressing terrorism, we are inadverdently helping expand terrorism like never before. Gee...we just forgot all about Bin Laden, America's true enemy. As a true American patriot and a career military man, I would never think about deserting, but more power to anyone who would rather live than go over to Iraq and die for NOTHING. There is no honor in fighting in that sensless war. We were supposed to learn something from Vietnam. Everyday fine American Warriors die for the most questionable war this country has ever fought. What abbout Afghanistan and Bin Laden...It is truly a sad tragidy, i feel sorry for the next president.

davidzill, i respect your understanding my decision. as to bin laden, isnt his daddy and our president's daddy business partners in the carlyl group, a weopons trading corp.?? its funny, bush's grand daddy also supported hitler in events leading up to WW2. I also like your comment on being a true patriot, somone who loves this country and would like it to live up to its potential, not someone who blindly agrees with everything some bible toting former coke addict says
