article 134 and 120


What is the name of your state (only U.S. law)? New Jersey

I'm an active duty service member with 15 years of service. Recently I found myself in a fight for my career. I became involved with a woman who was married. We never got into a sexual relationship due to her status. We did however send nude pictures back and fourth. He husband beat her up and gain access to her phone to get evidence against me. They do have an active case open with family services. I have not yet viewed the evidence against me. My unit has not talked to me about this case but have request legal services in prep for a Special Courts Martial. I have not yet talked with a lawyer because I haven't seen the evidence. A few of my friends that have been in similair situation have told me that adultery is very hard to prove so that charge will probably get dropped but the photos are still an issue. Her husband was the one who allegation against me. he is believing that an earlier affair between her and someone else is me.

The charges are Art 134 Adultery and Art 120 indecent conduct.

What should I do?

Hire legal representation or request representation.

15 years of "service" and facing the possibility of a SPCM;
as Peligroso27 suggested, get Counsel ASAP who will serve your best interests!
