Help AWOL advice


What is the name of your state? Army
A few days ago, I was found guilty in a summary court martial of Art 86 on three specifications. Sentence reduction to E-5, restriction 30 days.
Failure to Report on 9 May Guilty
That morning I went to formation, told the First Sergeant I had an appt with TDS regarding the charges below. That is correct, received a charge while seeking legal advice for a charge.
Signed out,signed in at TDS approx 15 min later (supporting documents submitted into evidence).
Unit's JAG, informed by 1stSGT of my location, called TDS, who informed them I would seek a court martial.
returned to Unit. ART 15 already processed max punishment.
Went to IG and TDS, Art 15 set aside, (pay corrected after two months and repeated IG inquiries)
30 Dec Failure to report Guilty
Leave approved 25-30 Dec.
called in from leave 31 Dec (non-duty day)
Leave period preceded and followed by non duty days
23 Sept 2004
arrived late read Art 31 rights.
I am now working on submitting clemency matters to the SCMCA. TDS here has informed me that I will not be provided assistance in doing so.
I, unfortunately, paid a civillian attorney who has indicated that additional payment will be required to assist me with an appeal. I would not seek his help in any event.
He interviewed no witnesses, had no idea why anyone was testifying or who they were. He did not object to statements from my supervisor and others being submitted into evidence. He also made no closing statement. Also the court reporters, same as from the previously mentioned Art 15 , They called called witnesses not on the witness list. TDS attorney is deployed, not available to testify regarding 9 May.
