AWOL Status? Or not?


What is the name of your state (only U.S. law)? AZ

My younger brother went awol back in 2005, he had claims that some dirty stuff was going down at his just recently commissioned unit. He tried contacting them on a few different occasions, and at one point he went in to sign adsep papers...They called him back later and said it was passed 180 days and that he was no longer attached to thier command so they couldn't do anything about it. So they said something about his paperwork got sent to chicago, chicago says they dont have it, everybody in his old command is brand new, and he has no 214 on file yet no awol or deserter paperwork were filed. What can he do? He is almost done with school now for criminal justice and he knows they are going to want to see a 214...clearly he cant show them anything, yet he is not awol?

I would like to let him know something. If he isnt attached to anybody's command and nobody has his service record, how is he supposed to get any info or get anything taken care of?...oh yeah, mypay still keeps posting the same month day and year on his monthly paystub, yet they are blank paystubs...

I am trying to help him out yet I am confused as hell...

He is clearly AWOL. You are confused because you assume that everything he has told you is the truth. His criminal justice degree is not going to be worth the paper it is printed on. What branch did he desert from?

The navy...I have called the personnel office myself, the only information they have on it is his EAOS...they said if he was AWOL it would be in there system, and they said it isn't...I have tried helping him get this take care of but if nobody has his service record and naval records has nothing what then?

Nobody you have talked to has his service record, it does exist. The personnel office would not be authorized to release information about your brother to you. Four years is a long time and records are often misplaced. I guarantee that he has an electronic record of his enlistment on file in St. Louis.

How do you know Naval Records has nothing? You would not be authorized to have his record released to you at any time. I applaud your efforts to help your soon to be unemployed brother but there is really nothing you can do. He will simply have to man up and accept his punishment sooner or later.
