BAH Fraud? depending on dependants location

Hi! My husband is active duty army and he is Pcsing to Ft. Drum NY in August 2009. We currently own a house in VA where we have been living. My husband is deploying around January 2010. Currently our BAH is $1000+ more than the BAH up in NY, he is not able to be a geographical bachelor on post unless he pays for housing, so basically we would have to pay for our mortgage and his rent until he deploys. It is a huge pay deduction and we cannot afford that size of a decrease in income. We are thinking of requesting to keep the current BAH since my daughter and I will be living here while is deployed. My question is it BAH fraud if we go stay with him for a month or two at a time and return home during that 6 mo. period? Technically we will be living/ visiting out of both residences....

Provided you do not leave the residence for 30 or more days, you are authorized to remain at the BAH rate of your current location.

Your husband may want to find a cheap room for rent in the meantime, possibly with another Soldier who owns a home up there. Forget finding a cheap apartment... Even the small ones go for more money near installations due to this exact scenario.
