Question

BAH question


What is the name of your state (only U.S. law)? CA
My husband just returned from a year in Iraq. He is VERY different and VERY short tempered. He decided he wants to be single and eventually get a divorce. This came out of the blue and was unexpected since we never got in a fight or anything. We have a one year old and a two year old. The kids and I have been financially dependant on him since he joined the Army 2 years ago.
My question is: Does he have to give me the BAH each month since he left me alone with the kids and I have no way of supporting them right now? He's claiming he only has to give me half. Many people have told me I am entitled to the entire BAH since I am the one taking care of our kids.

As long as the two of you are still married he is obligated to provide you with financial support. If he ever fails to provide you with the adequate support you need to approach his command. Once you are separated you will be granted a percentage of his pay based on a set formula. This will be granted through a court order and taken directly out of his check. You need legal representation for any proceeding dealing with this situation. Best of luck.
