Cell phone contract and military clauseWhile stationed in guam I began a two year contract with a local cell phone company ITE. After about 6 months in September of 2006 I had to leave guam to go to san diego to be discharged, so I cancelled my contract and provided my orders. Now they are sending me to collections and saying the I owe 600 dollars for early cancellation fee and that the military clause only applies when you have PCS orders and that I provided them with separation orders. I disagree b/c although I was separating I had to first recieve orders to go to San Diego and then I separated I did not leave the military from guam. What can I do I don't have the money to pay such a ridiculous charge. |

| It is hard to say, without seeing the language of the "military clause" that was in your contract. Their perspective probably is that once you are discharged you are free to live in Guam and continue the service, and since you are not involuntarily living elsewhere your contract binds you. Wtihout the text of the clause, however, it is all mere speculation. |

| I asked for a copy of my contract and what I recieved does not have any "word" on the specifics of their military clause. All it states is next to my signature "Early Cancellation Penalty waived with PCS orders" |
