Child Born after adultry in military


What is the name of your state? Louisiana

I am writing for my son who was in the Navy stationed in VA and now discharged. He fathered a child with a woman who was also in the Navy and is also now discharged. They were never married.

She was still married but seperated at the time of conception but was divorced when the child was born. My son was told that he could not be listed on the birth cert. as the father because she was not divorced at least 10 months at the birth of the child. The ex husband would have to be listed or she would have to leave the fathers name blank, which is what she did. However, she was allowed to give the child my son's entire name making the child a junior.

The problem now is they have split up and she has moved to another state. My son wants his name on the birth cert and to have visitation with the child, but she is not cooperating. Since the child was born in VA, my question is...does my son have to go through the VA legal system or can he pursue this in LA? Can you advise who he needs to contact to get the ball rolling?

Another question has come up with the situation. Can the military press adultry charges on both or either of them now even though they are no longer enlisted in the military?

Any info/advice is greatly appreciated.

I recommend posting your question under the child custody board. I can answer your last question: No, since they are no longer military they will not face adultery charges.
