child support, BAH.


What is the name of your state (only U.S. law)? Texas.

My husband was in a transition from active army to reserved guard this year, his status now is 'active' because he is in school and his rank is E-4. We got a home in Texas.

We are still married but "separate" since april 2008, his family kicked me out from the house for I didn't know what my husband told them ( my husband has been verbally abusive toward me and our son) . I am now 30 weeks pregnant and currently outside of USA seeking medical attention because he refused to update the DEERS info back then in the states that is why I have to fly back to my country. I am planning to go back soon to deal with legal issues.
Is he required to pay child support for our son who is 2 while we are "separating" ? if yes how much?

He said he only need to pay $150 separation allowance to me, is that true?

He want me to give birth in my country and also accused me that our son and unborn baby may come from other men and he said he has no responsibility to me and our children. He rent out the house in Texas and warned me not to go back to the US because I will have no where to live. Please give me any advice, thank you.

No that is not correct. You need to get a court order to require him to pay the minimum required amount for whatever state he lives in or the Army requirement. I believe the requirement for you is half of the BAH w/ dependent. There are many other threads that address this issue.

Thank you for your reply. I don't know how much is his BAH. He is in E-4, USA/RES, with active duty orders for over 30 days, how can I find out how much is his BAH?

That is public info, just type in BAH calculator on any search engine and you should be able to find out. military.com has one as well I think.
