command holding possible charge over my headI am a Marine in Wisconsin on recruiting duty. I own a home in missouri and went home for the weekend two months ago. On the way back my car broke down and I did not make it to work on time Monday morning. My command initially gave me a 6105 counseling but said it wouldn't actually be entered in my record as long as it didn't happen again. Now two months later the CO visited my office and told me that because my office hasn't made it's mission in three months that he may still NJP me for the offense. He stated that he didn't sign the 6105 and that it's still up in the air. I signed a 6105 for this already. Isn't there something illegal about him holding this over my head like this??? If an attorney with military law knowledge could help on this it's stressing me out as I have recently been selected for E-7 and they are holding all of this, supposedly, over my head |

| The counseling is just that. Were you under orders/directives/regulations to remain within a confined area (e.g. 150 miles of your duty station), and did you exceed that area? What, exactly, is he threatening tyo NJP you for (what articles of the UCMJ did you purportedly break)?

| article 86 unauthorized absence and article 92 failure to obey order or regulation (based on a policy letter 2 weeks prior ordering everyone in office in uniform by 0730 each day). Yes he is threatening NJP on the above charges instead of the 6105 which I was already counseled by the SgtMaj on and signed. Thanks for any assistance you can provide |
