Gonzo, contact your nearest Verterans Service Organization; they have Service Officers who can help you file a claim with the "VA" not the "Green Machine! And the best part is that, it is free; and of course, if you can find a Lawyer that specializes in "VA" Disability cases and will work with you on a contingency fee base, then super. I had a neck & shoulder injury in the Marine Corps in 1998 and was discharged in 2001 with a "10%" disability rating; thereby receiving severance pay. I have since continued to have problems as a result of my injuries and had another surgery in 2002. I have permanent nerve damage to my right shoulder/arm. I have had part of my collar bone removed and a rib removed. The VA has rated me at 50%, even though by adding up all of the different ratings I am 80% (I know that you can't just add ratings to get the VA rating). My question is, is it possible to challenge the Marine Corps' disability rating and get it upgrade to a 30% or higher, which would be medical retirement? Has anyone ever heard of that happening and what is the best method to pursue that? Am I better off getting a lawyer?
