Disparity? FTS conversion

What is the name of your state (only U.S. law)? USN

ok I am currently an Air Traffic Controller in the USN(R) (FTS)..The naval reserves has decided that all air traffic controllers must be converted to REGNAV by OCT.1...we (ATC's) were given 4 options. 1) Request Separation 2)Cross-rate to a different FTS rate 3) Reenlist REGNAV for atleast 2 yrs (regardless of time left on current contract) 4_Cross-rate to another rate in REGNAV.

Well, out of the 12 people at my air station that this effects, 9 have requested separtion. This is due to people not wanting to continue their navy careers further than what they originally signed for. Some people have 2 months left, and are expected to reenlist for two more years?? yeah right! So, our chain of command (all the way up to the CO of the base) has informed us that all of our separtion chits have been denied due to manning throughout the Air Traffic Facility. So everyone collectively said "ok" we will just cross rate FTS and finish our current enlistment. They have also denied these chits, saying that this will also cause the facility to be undermanned. So basically we have no options. One thing i did forget to mention is that the naval reserves will FORCE cross rate everyone OCT.1 if no action is taken. Due to this some people who are Frocked for promotion will lose their promoted rank and begin a different rate. Now 4 people at a different Air station have already been approved for separation. After talking to JAG they have brought up desparity. Since no controller/sailor here had a choice in their orders to be stationed here to this present duty station we can claim desparity, and pursue to get out.

So the question is..is this legit? for i havent personally talked to the jag and would just like some kind of reassurance! I realize its the 21 of sep and need an answer by the 1st!! our chain has been of no help and will not even give us answers
