Question

Does civilian disputes affect chain of commands decisions?


What is the name of your state? Hawaii

Hi, I am in the Navy, I recently had a falling out with my room mate which ended in me getting signed off the lease and her taking sole responsibility of the apartment. Unfortunately this was someone I worked with and we had to get switched out of each others section. There was never any problems between us at work only she decided to make phone calls to our LPO to update him on our situation. I am not legally binded to the lease any more and completely moved out of the apartment. My LPO told me today though that until this is all settled between my room mate and I that my CPO will not sign my Leave chit. I did not destroy the room or wreck anything I took pictures when I was done moving out. Is it ok for my CPO to not sign my leave chit because of this matter? I do not like bringing my personal business to work and because of the situation at hand I feel that it was unfair for them to tell me this. I feel this situation is between me and my room mate and a judge if it has to go that far. What can I do?What is the name of your state?

Well, you can use the chain of command...

Beware of that option. Even if you do win life may become significantly more difficult for you in the future.

Legally speaking, the granting of leave is usually a matter of discretion for your chain-of-command. In other words, it can deny you leave for just about any reason -- or no reason at all (the possible exceptions having to do with constitutionally protected 'classes' like race, religion, etc.). Secondly, your Chief is almost certainly not the final authority on leave. Normally, you CPO etc. will only reccomend or not - the final decision is up to the CO (though the odds are slim s/he would over rule the lower ranks). Thus, you CPO probably isn't "refusing to sign" but rather is not willing to endorse your request.

To put it another way, is the Chief putting "I advise against granting leave" on the form and then forwarding it up the chain? If he is simply 'holding' the leave request there is probably a violation of regs/policy. But you have to ask yourself how badly you need this leave. Upsetting your Chief could cause some real problems down the road...
