Harassment by navy


undefinedWhat is the name of your state? Illinois
The Navy is kicking my Son out for a DUI. He was convicted in state court for this so why is the Military also punishing him?I read a rticle from Free Advice that the militray usually does not punish for a offense for the offense once he was tried by the state. I beleive his "CMC" is harrassing him.He is put on a 45 day confinement without being with his wife and 3yr old daughter.Tuesday night he got VERY ill and was sent to the barracks.He was told he couldnt go to see a Doc untill the next day at 07:00.He was so ill he was 30minutes late for mustar and was told he was going to get another 45 days.My Son saved the m ilitary alot of money by not getting court marshaled. Navy & "CMC CLARKE'whats your problem?

I think the question is in the second sentence, "He was convicted in state court for this so why is the Military also punishing him?" Just trying to help.

because the military and civilan courts overlap, but in this case i think that its the same as if you got a DWI in a civilain job, and you got fired for it..

They are probably punishing him due to the paperwork and BS he caused them by breaking the law, among other things. After all, while he was being tried in civilian court, they probably had to find someone to do his job.

You said he was "ill", and they wouldn't let him go to the doctor until sick call the next morning? What did he have, ebola? Certainly whatever he had could have waited until morning.

To be put on confinement, he must have done something pretty severe. Or perhaps they gave him confinement instead of docking his pay, which would affect his family. The CMC doesn't generally issue punishment, so I betcha there is a WHOLE LOT more to this story that sonny boy isn't telling you.

For a person in the Navy not to see their family for 45 days isn't squat. Talk to someone whose spouse has been gone for six months or more, for reasons that weren't self-inflicted. Or how about talking to someone whose spouse is dead in combat? I bet one of them would be ecstatically happy if only their loved one was merely confined, as opposed to dead.
