Laws On Military Back PayWhat is the name of your state?Maryland After filing suit in the Federal Court Of Claims the govt. has agreed that I'm entitled to 8yrs back pay and and furthermore, agreed to a settlement.My question is what are the applicable tax laws(filing single with one dependent) and are there other non-tax issues and/or entitlements I should be aware of? | You would get taxed on the pay under the same rates that applied had you been paid properly the first time. E.g.: 1999 back pay: $5000 difference + $2000 BAH, they would tax the back pay itself at the 1999 tax rate, but BAH would not be taxed (because it never is). Hope this makes sense. And yes, you will need to file amended tax returns.
